through our compliance with this policy. Fizzyble Inc. is the data controller responsible for your
Personal Information.

you visit our online, digital or mobile services, including the website www.fizzyble.com, applications,
and any of our other products and services in connection with which this Privacy Policy is posted
or from which it is linked (collectively, the "Service"), how we use and protect that information,
and your rights regarding your personal information.
By accessing or using the Service, you agree to this privacy policy ("Privacy Policy"). If you do
not agree, please discontinue use of the Service. We may update this Privacy Policy periodically.
We will notify you of material changes by posting a notice on the Service or by other means as required
by law. For material changes that affect your rights under applicable law, we will obtain your affirmative
consent before the changes take effect. Your continued use of the Service after we provide notice

the Service, including mouse movements, clicks, and scrolling behavior. You can opt-out of

Purpose of collection: To display the Service properly, maintain Service performance and security,
conduct analytics, and improve and optimize your browsing experience. This information also supports
fraud prevention. With your prior consent, this information supports advertising and retargeting.
Source of collection: Automatically collected when you access the Service through cookies, tracking
technologies, and similar tools.
Disclosure for a business purpose: Shared with service providers that support analytics, advertising,
and hosting functions, including Google, Meta/Facebook, TikTok, Pinterest, Klaviyo, TripleWhale,
Redo, Bing, and DataShopper. These service providers are contractually obligated to use your Personal
Information only for the purposes for which it was disclosed and to maintain appropriate security
measures. Some of these third parties may be located outside the United States, and your information
may be transferred to, stored, and processed in other countries. For transfers outside the United
States, we implement appropriate safeguards to protect your Personal Information as required by applicable
law, including the use of Standard Contractual Clauses where applicable.
Order Information
Examples of Personal Information collected: Name, billing address, shipping address, payment
information (processed securely through Convesio), email address, and phone number.
Purpose of collection: To fulfill orders and provide our products and services, which includes processing
payments, arranging shipping, providing order confirmations, detecting and preventing fraud, communicating
with you regarding your order, and sending marketing and promotional communications when consistent
with your preferences.

Customer Support Information

Disclosure for a business purpose: Shared with Zendesk, our customer service platform.
SHARING PERSONAL INFORMATION
We share your Personal Information with trusted service providers who assist us in providing our services and fulfilling our contractual obligations. For example:
- We share information with Convesio, 33 Degrees, Zendesk, DataShopper, and analytics/advertising partners for order fulfillment, payment processing, customer service, performance analytics, and targeted advertising.
- We may share Personal Information as required by law (e.g., to comply with a subpoena, court order, or lawful request).
MARKETING, EMAIL & SMS COMMUNICATIONS
We use Klaviyo for email and SMS marketing.
We send:

- Cart abandonment emails/SMS
We use cookies to help track items placed into your cart, including when a checkout is
abandoned. With your prior express consent, this allows us to send abandoned-cart reminders via
SMS through Klaviyo.
We value your privacy and the information you consent to share in connection with our SMS marketing
program. By providing your mobile phone number and checking the opt-in box, you expressly consent
to receive recurring marketing and transactional text message notifications from Fizzyble Inc. and our
service providers (including order updates and abandoned-cart reminders via SMS through Klaviyo)
using an automatic telephone dialing system, prerecorded/artificial voice, or other technology, even
if your mobile number is registered on any state or federal Do Not Call list. Consent is not a condition
of purchase. Message and data rates may apply, and you are responsible for all charges and fees associated
with SMS and text messages imposed by your wireless provider. Message frequency varies.
You may opt-out any time by replying STOP to any message, following in-message unsubscribe links,
or by contacting us at contact@fizzyble.com. For help, reply
HELP or contact us at contact@fizzyble.com. Once you opt-out,
you will receive a one-time opt-out confirmation text message. No further messages will be sent
to your mobile device, unless initiated by you.
We may change any short code or telephone number we use to operate the Service at any time and will
notify you of these changes. You acknowledge that any messages you send to a short code or telephone
number we have changed may not be received and we will not be responsible for honoring requests made
in such messages.
Your SMS opt-in information and phone number will not be shared with third parties for their own
marketing purposes. We may share this information with service providers who assist us in delivering
SMS messages (such as Klaviyo), who are contractually prohibited from using your information for
any purpose other than providing services to us.
To the extent permitted by applicable law and subject to our Terms of Service, neither we nor the wireless carriers supported by the Service are liable for failed, delayed,
misdirected or undelivered messages, any errors in such messages, and/or any action you may or
may not take in reliance on such messages.
BEHAVIORAL ADVERTISING
As described above, we use Personal Information to provide you with targeted advertising and marketing communications that we believe may interest you. For example:

Right to Access

Right to Opt-Out of Sale or Sharing
You have the right to opt-out of the sale or sharing of your Personal Information. Under the CCPA, "sale" means disclosing Personal Information to a third party for monetary or other valuable consideration, and "sharing" means disclosing Personal Information to a third party for cross-context behavioral advertising. We also honor Global Privacy Control (GPC) browser signals as a valid opt-out request. Right to Correct
You may request that we correct inaccurate Personal Information we maintain about you. Upon verifying your identity and the inaccuracy, we will use commercially reasonable efforts to correct the inaccurate Personal Information, taking into account the nature of the Personal Information and the purposes of processing. We will respond to your request within 45 days (or up to 90 days if reasonably necessary, with notice).
Authorized Agents
You may designate an authorized agent to submit requests on your behalf. To designate an authorized agent, you must provide the authorized agent with written permission to do so, and we may require you to verify your identity directly with us and confirm that you provided the authorized agent permission to submit the request. We may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.
California Invasion of Privacy Act
We comply with the California Invasion of Privacy Act (Cal. Penal Code § 630 et seq.) regarding the interception and recording of communications. This provision does not affect your rights under the CCPA or other privacy laws.
California "Shine the Light"

OTHER US STATE PRIVACY LAWS

CHILDREN'S PRIVACY
We do not knowingly collect or solicit Personal Information from children under age 13 without
verifiable parental consent as required by the Children's Online Privacy Protection Act (COPPA).
The Service is not directed to children under 13. We also do not knowingly sell or share the
Personal Information of consumers under 16 years of age without affirmative authorization as
required by the CCPA.
If you are a parent or guardian and believe we may have collected Personal Information from a child
under 13 without verifiable parental consent, or from a minor under 16 without proper authorization,

will promptly investigate and delete that information as required by law.
RETENTION
We retain the Personal Information we collect only for as long as reasonably necessary for the purposes described in this Privacy Policy or as required by law. Specifically, we retain your information: (1) for as long as your account is active or as needed to provide you services; (2) as necessary to fulfill your orders and provide customer service; (3) as necessary to comply with our legal, tax, accounting, and record-keeping obligations (typically 7 years for financial records); (4) as necessary to resolve disputes and enforce our agreements; and (5) as otherwise permitted or required by applicable law.
